Are You Paying Your Staff Correctly?

From 1 January 2025, underpaying an employee’s wages or entitlements can be a criminal offence if the underpayment is “intentional”.

A small business employer can’t be referred for criminal prosecution if the Fair Work Ombudsman is satisfied that the business has complied with Voluntary Small Business Wage Compliance Code.

For most small businesses, you will comply with the code if you aren’t intending to underpay your employees. The factors that are assessed are not new if you are a compliant employer, and you are likely to be undertaking the steps as part of your good business practise.
